1. Services

This Terms of Use Agreement (the "Agreement") governs the access and use of services provided through the web platform at www.sofiatherapy.ca (the "Website"), operated by Sofia Therapy, LLP. ("we," "us," "our," or "Sofia Therapy"). The Services include connection with registered psychotherapists, appointment scheduling, administrative functions, billing, and related support (collectively, the "Services"). Users (“you,” “your,” or "User(s)") accessing the Website may create an account and book appointments through a third-party platform, Jane App (“Jane”). Sofia Therapy facilitates the connection between Users and registered psychotherapists in Ontario, Canada, through Jane. All psychotherapy services are provided exclusively by independent, regulated health professionals (the “Therapists”), who are responsible for their clinical services and compliance with Ontario's health regulations. Sofia Therapy provides administrative support, but does not offer direct psychotherapy services.

Please note that by using our Services, you are consenting to the use of Jane to manage appointments, treatment records, and communications. You are also consenting to Jane’s Terms of Use and Privacy Policy, as applicable. We encourage you to review these policies before proceeding.

2. User Registration and Accounts

To access certain features of the Website, including booking appointments with Therapists, you must create a user account (“User Account”) through Jane. In registering for an account, you agree to provide accurate and complete information and to update such information as needed. You are responsible for maintaining the confidentiality of your User Account and password and for any activities conducted under your account. Sofia Therapy reserves the right to terminate or suspend your account if any false or misleading information is provided.

3. No Emergency Services

Sofia Therapy does not provide emergency mental health services. In the case of a medical or mental health emergency, you should immediately contact your local emergency services or dial 911. Our Website and Services are not designed for emergency treatment or crisis intervention.

4. No Health Provider Relationship with Sofia Therapy

The provision of administrative and technological support via Sofia Therapy does not establish a health care provider relationship between you and Sofia Therapy. Your health care provider relationship is exclusively with the independent psychotherapist (Therapist) to whom you are connected. Sofia Therapy is not responsible for the clinical treatment or outcomes related to the services provided by Therapists.

5. Fees and Payment

Sofia Therapy manages billing for Therapists, but credit card payments for psychotherapy services are processed through Jane App. Please review the Jane App Terms of Use for details on credit card payments: https://jane.app/legal/terms-of-use

While Sofia Therapy charges Therapists a fee for connecting them with Users, there is no cost to you for using our Services.

The Therapists have authorized Sofia Therapy to handle billing for client services. Payment is required either before session or within 24 hours of the session. If payment is not made within 7 days, you will receive an email reminder. After 14 days, we will contact you to explore any payment barriers and discuss financing options.

Failure to pay fees promptly may result in the termination of your Services and User Account by Sofia Therapy.

6. User Conduct

You agree to use the Website and Services in compliance with all applicable laws and regulations. Any misuse of the Services, including but not limited to abusive behavior towards staff or Therapists, may result in suspension or termination of your access to the Services.

7. Privacy and Security

Sofia Therapy is committed to protecting your personal health information in compliance with the Personal Health Information Protection Act (PHIPA). By using the Website and Services, you consent to the collection, use, and disclosure of your information as outlined in our Privacy Policy.

The Jane platform also adheres to high standards for protecting your data. However, we cannot guarantee the security of any data transmitted electronically. Any such transmission is at your own risk.

8. Intellectual Property

All content available on the Website, including text, images, logos, and code, is the property of Sofia Therapy or its licensors. You are granted a limited license to use the Website for personal, non-commercial purposes. Any reproduction, distribution, or unauthorized use of Website content is strictly prohibited.

9. Third-Party Links

The Website may contain links to third-party websites, including those operated by Jane or other service providers. These links are provided for your convenience only, and Sofia Therapy does not endorse or assume responsibility for the content or practices of these third-party websites.

10. Limitation of Liability

In no event shall Sofia Therapy, its directors, employees, or affiliates be liable for any indirect, incidental, or consequential damages resulting from your use of the Website or Services. Sofia Therapy assumes no responsibility for the services provided by Therapists or the outcomes of any therapy.

11. Termination

Sofia Therapy reserves the right to terminate or suspend your access to the Website and Services at any time, with or without notice, for conduct that we believe violates this Agreement or is otherwise harmful to other Users or our operations.

You may terminate your User Account at any time by sending an email request to admin@sofiatherapy.ca.

12. Governing Law

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes arising out of or relating to this Agreement will be resolved in the courts of Ontario, Canada.

13. Changes to the Terms of Use

Sofia Therapy may update this Agreement from time to time. Changes will be posted on the Website with a revised “Last Updated” date. Continued use of the Services after such changes constitutes acceptance of the new terms.
